This book examines the existing constitutional and legal system in England, Wales and Scotland, through the prism of its treatment of religion and belief. The study encompasses questions of Church/state relations, but pushes far beyond these. It asks whether the approach to religion which has spread out from establishment to permeate the whole legal framework is a cause of concern or celebration in relation to individual and collective freedoms. The primary focus of the work is the synergy between the religious dimension of the juridical system and the fundamental pillars of the Constitution (parliamentary sovereignty, the rule of law, separation of powers and human rights). Javier García Oliva and Helen Hall challenge the view that separation between public and religious authorities is the most conducive means of nurturing a free and democratic society in modern Britain. The authors explore whether, counter-intuitively for some, the religious dynamic to the legal system actually operates to safeguard liberties, and has a role in generating an inclusive and adaptable backdrop for our collective life. They suggest that the present paradigm brings benefits for citizens of all shades of religious belief and opinion (including Atheist and Humanist perspectives), as well as secondary advantages for those with profound beliefs on non-religious matters, such as pacifism and veganism. In support of their contentions, García Oliva and Hall examine how the religious dimension of the legal framework operates to further essential constitutional principles in diverse settings, ranging from criminal to family law. In a groundbreaking move, the authors also set the legal discussion alongside its social and cultural context. They consider how the theological perspectives of the larger faith traditions might influence members’ ideas around the key constitutional precepts, and they include extracts from interviews which give the personal perspective of more than 100 individuals on contemporary issues of law and religious freedom. These voices are drawn from a range of fields and positions on faith. While the authors are at pains to stress that these sections do not support or advance their legal or theological conclusions, they do provide readers with a human backdrop to the discussion, and demonstrate its crucial importance in twenty-first century Britain.

Through years of fieldwork in the state of Oaxaca, Mexico, art historian and archaeologist Alessia Frassani formulated a compelling question: How did Mesoamerican society maintain its distinctive cultural heritage despite colonization by the Spanish? In Building Yanhuitlan, she focuses on an imposing structure—a sixteenth-century Dominican monastery complex in the village of Yanhuitlan. For centuries, the buildings have served a central role in the village landscape and the lives of its people. Ostensibly, there is nothing indigenous about the complex or the artwork inside. So how does such a place fit within the Mixteca, where Frassani acknowledges a continuity of indigenous culture in the towns, plazas, markets, churches, and rural surroundings? To understand the monastery complex—and Mesoamerican cultural heritage in the wake of conquest—Frassani calls for a shifting definition of indigenous identity, one that acknowledges the ways indigenous peoples actively took part in the development of post-conquest Mesoamerican culture. Frassani relates the history of Yanhuitlan by examining the rich store of art and architecture in the town’s church and convent, bolstering her account with more than 100 color and black-and-white illustrations. She presents the first two centuries of the church complex’s construction works, maintenance, and decorations as the product of cultural, political, and economic negotiation between Mixtec caciques, Spanish encomenderos, and Dominican friars. The author then ties the village’s present-day religious celebrations to the colonial past, and traces the cult of specific images through these celebrations’ history. Cultural artifacts, Frassani demonstrates, do not need pre-Hispanic origins to be considered genuinely Mesoamerican—the processes attached to their appropriation are more meaningful than their having any pre-Hispanic past. Based on original and unpublished documents and punctuated with stunning photography, Building Yanhuitlan combines archival and ethnographic work with visual analysis to make an innovative statement regarding artistic forms and to tell the story of a remarkable community.

Missionary Mendicant friars arrived in New Spain shortly after Cortes's conquest of the Aztec empire in 1521 and immediately related their own European architectural and visual arts styles to the tastes and expectations of native Indians. Right from the beginning the friars conceived of conventos as a special architectural theater in which to carry out their proselytizing. Over four hundred conventos were established in Mexico between 1526 and 1600, and more still in New Mexico in the century following, all built and decorated by native Indian artisans who became masters of European techniques and styles even as they added their own influence. The author argues that these magnificent sixteenth and seventeenth-century structures are as much part of the artistic patrimony of American Indians as their pre-Conquest temples, pyramids, and kivas. Mexican Indians, in fact, adapted European motifs to their own pictorial traditions and thus made a unique contribution to the worldwide spread of the Italian Renaissance. The author brings a wealth of knowledge of medieval and Renaissance European history, philosophy, theology, art, and architecture to bear on colonial Mexico at the same time as he focuses on indigenous contributions to the colonial enterprise. This ground-breaking study enriches our understanding of the colonial process and the reciprocal relationship between European friars and native artisans.
